2. Intellectual Property Rights

All content on the MushCreeRoom.com Site, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, the "Content"), is the property of MushCreeRoom, its licensors, or its content suppliers and is protected by international copyright laws. The trademarks, service marks, and logos ("Trademarks") used and displayed on this Site are registered and unregistered Trademarks of MushCreeRoom and others. The "MushCreeRoom" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MushCreeRoom or its affiliates or licensors. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

4. Product Sales & Orders

Product Descriptions: We strive to be as accurate as possible in the descriptions of our products, including "Mini Kit," "Wellness Kit," "Aesthetic Kit," and "MycoCraft" items. However, MushCreeRoom does not warrant that product descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. All descriptions, images, and prices are subject to change at any time without notice, at our sole discretion.

Pricing: All prices displayed on the Site are quoted in the currency specified and are subject to change without notice. While we try to ensure accurate pricing, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat the order as cancelled.

Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. MushCreeRoom reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.

Payment: We accept various forms of payment as indicated on the Site. By submitting an order, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your order (including taxes, shipping, and handling) to that payment method. All payment transactions are processed through secure third-party payment gateways. We do not store your full credit card details on our servers.

Shipping: We will ship products to the address you provide. Shipping costs and estimated delivery times will be calculated and displayed at checkout. Please note that delivery times are estimates and not guarantees. Delays may occur due to unforeseen circumstances, including but not limited to carrier issues, weather, or customs processing for international orders. Risk of loss and title for items purchased from MushCreeRoom pass to you upon our delivery to the carrier.

Returns and Refunds: Due to the perishable and biological nature of some of our products (e.g., spore blocks), our return policy is specific. Please refer to our dedicated Return Policy page (link provided in footer or accessible via customer service) for detailed information on eligibility, process, and conditions for returns and refunds. Generally, returns for perishable items are only accepted if the product is defective upon arrival. Non-perishable items (like "MycoCraft" decor) may have different return conditions.

Cancellations: Orders can be cancelled if they have not yet been processed for shipping. Once an order has entered the shipping process, it cannot be cancelled. Please contact customer service as soon as possible if you wish to cancel an order.

Product Use and Disclaimer: MushCreeRoom products are intended for legal cultivation and educational purposes only. We do not endorse or encourage the cultivation of illegal or restricted fungi. Users are solely responsible for understanding and complying with all local, state, and federal laws regarding the cultivation, possession, and consumption of any mushroom species. We explicitly disclaim any responsibility for adverse effects resulting from the use or misuse of our products or the information provided on our site. 5. Community Guidelines

The "Community Sporeboard" and "Grow Room Inspo Gallery" are vibrant spaces for sharing knowledge, experiences, and inspiration. To maintain a positive and respectful environment, all users must adhere to the following guidelines:

• Respectful Conduct: Treat all members with respect. Harassment, hate speech, discrimination, or personal attacks are strictly prohibited. Engage in constructive discussions and disagreements.
• Relevant Content: All posts, comments, and submissions (including photos for "Room of the Month") must be relevant to indoor mushroom cultivation, mycology, botanical design, or related topics as per the MushCreeRoom brand concept.
• No Illegal Activities: Do not post content that promotes, facilitates, or discusses illegal activities, including the cultivation or use of illegal substances. This includes any content that violates local, state, or federal laws.
• No Spam or Self-Promotion: Do not post unsolicited advertisements, chain letters, pyramid schemes, or any other form of "spam." Excessive self-promotion of external products or services is not allowed without prior authorization from MushCreeRoom.
• Original Content: Only post content that you have the right to share. Do not post copyrighted material without permission. By submitting content, you grant MushCreeRoom the license specified in Section 2.
• Privacy: Do not share personal information of yourself or others (e.g., full names, addresses, phone numbers, private emails) in public forums. Be mindful of what you disclose.

MUSHCREEROOM MAKES NO WARRANTY THAT (I) THE SITE WILL MEET YOUR REQUIREMENTS; (II) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS; AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

7. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT MUSHCREEROOM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF MUSHCREEROOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SITE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SITE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; (V) ANY OTHER MATTER RELATING TO THE SITE.

IN NO EVENT SHALL MUSHCREEROOM'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE OR PURCHASING PRODUCTS THROUGH THE SITE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

You agree to indemnify, defend, and hold harmless MushCreeRoom, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Contributions, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

This indemnification includes, but is not limited to, any claims arising from your improper identification or consumption of mushrooms, your failure to comply with local laws regarding cultivation, or any harm caused by content you submit to the "Community Sporeboard" or "Grow Room Inspo Gallery." Your commitment to responsible use of the Site and its products is paramount.

These Terms shall be governed and construed in accordance with the laws of Dreamland, Earth, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Site, and supersede and replace any prior agreements we might have had between us regarding the Site.

Any legal action or proceeding relating to your access to or use of the Site or these Terms shall be instituted in the courts located in Dreamland, Earth. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
